 Three face federal obscenity charges for online porn
Free Speech admin writes "Three men were indicted by a grand jury in Dallas, Texas, on charges stemming from their sale of adult videos from their Web site. The three men were former business partners of Garry and Tamara Ragsdale, who were earlier sentanced to prison on obscenity charges. The videos in question featured staged rape scenes and BDSM depictions. Like the ongoing "Extreme Associates" case, this new case also involves both content that was mailed to physical locations in the United States as well as content that was available for download from the Internet."

 Adult novelty shop owners charged with obscenity
Free Speech admin writes "One year after raiding adult novelty store Bad Kitty, Lafayette police have officially filed obscenity charges against store owners Ryan and Erika Hargroder. A spokesperson for the ACLU pointed out the inherent unjustness of obscenity laws, their difficulty to understand, and the problems that they pose for Free Speech in America."

 Congress Mulls Parents' Empowerment Act
Free Speech admin writes "Family News in Focus is reporting that Congress is considering enacting a new law that would allow parents to sue Web site owners for $10,000 if they place material that is "harmful to minors" in a place that it can be "reasonable" expected that children would access. The "harmful to minors" label could conceivably include not just sex acts, but simple nudity, violence (think video games) and even some medical information. This would of course affect all free sites, TGP sites, Web site tours, and a number of other forms of erotic expression. "

 Feds Talk About More Obscenity Indictments
Free Speech admin writes "AVN is reporting that grand juries across the country are considering a rush of obscenity indictments against the porn industry. Here's an excerpt from that article: 'A federal prosecutor revealed that there are currently 17 federal grand juries considering obscenity indictments across the country, and 50 more cases are being considered. Mary Beth Buchanan, the U.S. Attorney prosecuting the 10-count indictment against Extreme Associates, Rob Zicari, and Janet Romano on obscenity charges, told the Pittsburgh Tribune-Review that after a decade of lax enforcement it was time for the Justice Department to crack down on obscenity violation.'

 Prosecutors seek conservative venues for porn trials
Free Speech admin writes "PittsburghLive.com reports: "Pittsburgh and other socially conservative cites are becoming the latest battlegrounds between federal prosecutors and the pornography industry. Besieged with complaints about explicit images easily accessible to children via the Internet, the U.S. Justice Department is cracking down on the producers of obscene Web sites, videos and other materials. Instead of taking the traditional path of bringing criminal charges where the materials are made, prosecutors are now trying cases where the items are distributed -- often before juries like those in Pittsburgh, which are more likely to find the materials obscene. Federal prosecutors scored obscenity convictions in New York and Los Angeles in 2003, but they also racked up wins in western Missouri and southern Texas and West Virginia."
